Summary of contents:
PARTIES John COLE of Marton, Lincolnshire (Yeoman) Amy COLE, the wife of John Cole. Thomas HUTTON of Gate Burton, Lincolnshire (Esquire) SUBJECT John and Amy Cole undertake to levy a Fine on property in Brampton, parish of Torksey, Lincolnshire. The Fine will assure the property to the use of Thomas Hutton, who, as soon as possible thereafter, will mortgage it to raise £100 for the benefit of John and Amy Cole during their lives. After the death of both of them he will sell the property and distribute any balance as follows : 1) One half share to their granddaughter Mary Cole, spinster. 2) The other half share divided equally between their children Thomas Cole, Amy the wife of John Burnett and Mary the wife of John Bellamy. The property consists of 3 tenements, 30 acres of land dispersed among the open fields of Brampton, plus common pasture of 15 Beastgates and 27 Sheep gates. We are told that it had formerly been owned by Thomas Cole, father of John, and had been given to John and Amy Cole on their marriage in 1732. Unfortunately the seals and signatures of John and Amy Cole have been cut off. Maybe the contract was never executed and the signatures were cut off to invalidate it, or maybe they were simply cut off by someone who collects such seals. Thomas Hutton never signed the document but, for example in the case of conveyances, it is quite usual that the purchaser of the property doesn't sign. Notwithstanding the missing signatures there is a lot of information here about the family and land of John and Amy Cole.
