Subject Frederick and Elizabeth Banks are borrowing £1000 from Richard Smith on security of property in or near Dawlish, Devon. the property is detailed in a schedule to the indenture which lists 21 closes of land totalling 67 acres together with a dwelling house, barn, cellar and cottage. It is all called 'Weston' or 'The Weston Estate'. We are told that there is a complication of "a certain Suit of a Neck and Wood pending in the High Court of Chancery". Any payments which might result would be a charge on the property which would affect Richard Smith's security.
